Cross-border secondment obliges employers to observe specific rules, mainly of EU directives, to ensure the minimum level of protection of seconded employees. As a rule, the terms and conditions of employment of a seconded worker must not be worse than those applicable in the country to which he is posted. Failure to observe that rule may lead to adverse consequences for the employer – from a dispute with the worker to financial consequences.
