Rödl & Partner's specialists will check especially the legal and actual status of a real property, the legal title to the real property (including any third party claims for restitution), thus securing the legal interest of clients who transact real properties in Poland and in more than one hundred countries around the world. Rödl & Partner's advisers will also check the spatial development plan for the property, the existing or planned buildings that are/can be erected there, access to a public road, encumbrances on or for the benefit of the real property, environmental conditions and potentially adverse consequences for the environment, as well as any pending or threatened court or administrative proceedings against the property.






What we do:

  • review the land and mortgage register (in terms of ownership, perpetual usufruct, encumbrances on or for the benefit of the real property, such as mortgages, easement/servitude);
  • check proceedings pending against the real property, including claims for restitution;
  • review excerpts and drawings from the land and building register;
  • check if the existing buildings have been erected, commissioned and are used in compliance with the applicable regulations;
  • carry out a legal review of project documentation for erecting a building or structure in line with the applicable regulations;
  • check the intended purpose of a real property according to the local spatial development plan or a zoning decision.
